Pixel Haven – Terms of Service

Welcome to Pixel Haven. These Terms of Service (“Terms”) govern your access to and use of the Pixel Haven website (the “Site”) and your purchase and use of the digital products we sell. By accessing the Site or placing an order, you agree to be bound by these Terms. If you do not agree, please do not use the Site.
Pixel Haven (“we,” “us,” or “our”) operates this Site. If you have questions, contact us at buildapixelhaven@gmail.com.
1. Eligibility
To purchase from the Site, you must be at least 18 years old, or the age of majority in your jurisdiction, and able to enter into a legally binding contract. By placing an order, you represent that you meet these requirements and that the information you provide is accurate and complete.
2. Accounts
You may need to create an account to purchase or access certain digital products. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at buildapixelhaven@gmail.com if you suspect unauthorized use. We may suspend or terminate accounts that violate these Terms.
3. Products and Descriptions
Pixel Haven sells digital products only, which are delivered electronically (for example, by download link or account access). We make reasonable efforts to describe our products accurately, but we do not warrant that descriptions, images, or other content are complete, current, or error-free. Colors and appearance may vary depending on your device and display.
We reserve the right to modify, discontinue, or limit the availability of any product at any time without liability to you.
4. Orders, Pricing, and Payment
All prices are listed in USD and are subject to change without notice. We reserve the right to refuse or cancel any order, including orders that we believe are fraudulent, placed in error, or that violate these Terms.
Taxes. Pixel Haven is based in Anchorage, Alaska, which does not impose a state or municipal sales tax. Alaska has no statewide sales tax; sales tax is levied only by certain local jurisdictions. Where we are required to collect sales, use, or similar taxes (for example, on sales delivered into an Alaska jurisdiction that levies such a tax where we have a collection obligation, or into another taxing jurisdiction where we have a tax obligation) the applicable tax will be calculated and shown at checkout and added to your total. You are responsible for any taxes, duties, or charges imposed by your own jurisdiction that are not collected by us.
Payment is processed through our third-party payment providers, which may include WooPayments, Stripe, and PayPal. By submitting payment information, you represent that you are authorized to use the payment method and you authorize us (through our processor) to charge the total order amount. Your payment is also subject to the provider’s terms and privacy policy.
If a product is listed at an incorrect price due to a typographical or system error, we reserve the right to cancel the order even if it has been confirmed, and we will refund any amount charged.
5. Delivery of Digital Products
Digital products are delivered electronically after your payment is successfully processed. Delivery is typically made available immediately or shortly after purchase, via a download link, your account dashboard, or email. Access to downloads may be time-limited or download-count limited, as indicated on the product page.
It is your responsibility to ensure you provide a valid email address and to download and securely store your files. We are not responsible for delivery failures caused by incorrect information you provide or by your device, network, or email configuration. If you do not receive your product, contact us at buildapixelhaven@gmail.com and we will help.
6. License to Use Digital Products
Unless a product page or a separate license states otherwise, when you purchase a digital product we grant you a limited, non-exclusive, non-transferable, non-sublicensable license to use that product for your own personal or internal business use.
Unless expressly permitted, you may not:
- resell, redistribute, sublicense, lease, or otherwise make the product available to third parties;
- share, publicly post, or upload the product to file-sharing services;
- claim the product as your own or remove any copyright or proprietary notices;
- use the product for any unlawful purpose.
All intellectual property rights in the products remain with Pixel Haven or its licensors. Purchasing a product does not transfer ownership of any intellectual property to you. If a product includes its own license terms, those terms control to the extent they conflict with this section.
7. Refunds
Because our products are digital and delivered electronically, we offer refunds under the following policy:
- You may request a refund within 30 days of purchase.
- Refunds are considered where the product is faulty, materially not as described, or where you are otherwise entitled to a refund under applicable consumer-protection law.
- To request a refund, contact us at buildapixelhaven@gmail.com with your order number and the reason for the request.
We reserve the right to decline refund requests that we reasonably believe are abusive — for example, where a product has been fully downloaded and used and there is no defect, or where refund requests are made repeatedly. Approved refunds are issued to your original payment method. Once a refund is issued, your license to use the product ends and you must delete all copies.
Nothing in this section limits any statutory rights you may have under the consumer-protection laws that apply to you.
8. Acceptable Use
When using the Site, you agree not to:
- violate any applicable law or regulation;
- infringe the intellectual property or other rights of any party;
- upload or transmit viruses, malware, or other harmful code;
- attempt to gain unauthorized access to the Site, its servers, or other users’ accounts;
- interfere with or disrupt the integrity or performance of the Site;
- use automated means (bots, scrapers) to access the Site without our permission;
- engage in fraudulent, abusive, or otherwise objectionable conduct.
We may investigate violations and cooperate with law enforcement, and we may suspend or terminate your access for any breach of these Terms.
9. User Content
If the Site allows you to submit content — such as comments, reviews, or form submissions — you retain ownership of your content but grant us a non-exclusive, royalty-free, worldwide license to use, display, reproduce, and distribute that content in connection with operating and promoting the Site. You are responsible for the content you submit and represent that you have the right to submit it and that it does not violate any law or third-party right. We may remove content at our discretion.

10. Communications and Marketing Emails
By providing your email address, you agree that we may send you communications related to your orders and account. With your consent, we may also send marketing emails. You can opt out of marketing emails at any time by using the unsubscribe link in any such email or by contacting us at buildapixelhaven@gmail.com. Once you request that we stop, we will not send you further marketing emails and will not share your email address with others except as needed to process your removal request. 11. Intellectual Property
The Site and its content (including text, graphics, logos, images, product designs, and software) are owned by or licensed to Pixel Haven and are protected by copyright, trademark, and other laws. Except as expressly permitted, you may not copy, reproduce, distribute, modify, or create derivative works from any part of the Site without our prior written consent.
12. Third-Party Links and Services
The Site may contain links to third-party websites or services (such as payment processors, analytics, and marketing tools) that we do not control. We are not responsible for the content, policies, or practices of any third party. Your use of third-party services is governed by their own terms and privacy policies.
13. Disclaimer of Warranties
The Site and products are provided on an “as is” and “as available” basis, without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, secure, or error-free, or that products will meet your expectations. Some jurisdictions do not allow the exclusion of certain warranties, so some of these exclusions may not apply to you.
14. Limitation of Liability
To the fullest extent permitted by law, Pixel Haven and its owners, employees, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising out of or related to your use of the Site or products. To the extent we are found liable, our total liability will not exceed the amount you paid for the product giving rise to the claim.
Some jurisdictions do not allow the limitation or exclusion of certain damages, so some of these limitations may not apply to you. Nothing in these Terms limits liability that cannot be limited under applicable law.
15. Indemnification
You agree to indemnify and hold harmless Pixel Haven and its owners, employees, and affiliates from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of or related to your breach of these Terms, your misuse of the Site or products, or your violation of any law or third-party right.
16. Termination
We may suspend or terminate your access to the Site or your account at any time, with or without notice, if we believe you have violated these Terms or for any other reason at our discretion. Upon termination, your right to use the Site and any licensed products ceases, though provisions that by their nature should survive (such as intellectual property, disclaimers, limitation of liability, and indemnification) will continue to apply.
17. Changes to These Terms
We may update these Terms from time to time. When we do, we will revise the “Last updated” date above and, where appropriate, provide additional notice. Your continued use of the Site after changes take effect constitutes acceptance of the revised Terms. We encourage you to review this page periodically.
18. Governing Law and Disputes
These Terms are governed by and construed in accordance with the laws of the State of Alaska, United States, without regard to its conflict-of-laws principles. You agree that any dispute arising out of or relating to these Terms or the Site will be subject to the exclusive jurisdiction of the state and federal courts located in the Third Judicial District at Anchorage, Alaska, and you consent to personal jurisdiction there.
Nothing in these Terms limits any rights you may have under the Alaska Unfair Trade Practices and Consumer Protection Act (AS 45.50.471 et seq.) or under the mandatory consumer-protection laws of the jurisdiction in which you reside. Where the law of your home jurisdiction provides you with protections that cannot be waived by agreement, those protections continue to apply to you.
If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
